“They’ve fallen and we don’t have workers’ Comp”

Gone are the days of believing that if your vendor has worker’s compensation then the association is covered in the event of an accident.

More and more associations are protecting themselves by purchasing worker’s compensation policies.

If your association has a contract with a contractor to do landscaping, repairs etc. around the community make sure that contractor has workers’ compensation and employee liability insurance.   According to Va. law if a contractor or his employee(s) gets hurt on your premises and does not have workers’ compensation and employee liability insurance or has dropped the policy, the association could be held responsible.

Make sure you have a current copy of the insurance on file.  Additionally, make sure the association (or your management company) is listed as a policy holder, especially if your association uses the contractor a great deal.   As a policy holder the insurance company is required to provide you with updated information such as renewals and more importantly cancellations.
